1. Acceptance
By creating an account or using LYVITNOW (the “Service”), you agree to these Terms. If you don't agree, don't use the Service. LYVITNOW is operated by AlyveVentures under the Vitality Pillar (“we,” “us”).
2. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the Service. By using it, you confirm you meet this requirement.
3. Your account
You're responsible for keeping your password secure and for activity that happens under your account. Notify us at support@lyvitnow.com if you believe your account has been accessed without your permission.
4. Free early access and future paid plans
- LYVITNOW is currently in free early access. There is no charge, no card on file, and no automatic billing.
- We plan to introduce paid plans in the future. If and when that happens, we will notify you by email in advance, and you will be able to decide whether to subscribe before any charges could occur.
- Founding members who join during early access will receive grandfathered pricing when paid plans launch. We will confirm those terms in writing at that time.
- No payment method is required to use the Service today. Nothing in these Terms authorizes us to charge you unless and until you explicitly subscribe to a paid plan.
5. Acceptable use
You agree not to: (a) reverse-engineer or scrape the Service, (b) abuse, harass, or impersonate others through the Service, (c) attempt to break the Service's security, or (d) use the Service for any unlawful purpose.
6. Health disclaimer
LYVITNOW provides general fitness and nutrition information generated by software. It is not medical advice and is not a substitute for consultation with a qualified healthcare professional. Consult your doctor before starting any new exercise or nutrition program, especially if you have a medical condition, are pregnant, or have any concerns. You assume all risk associated with physical activity.
7. AI-generated content
Workout plans, meal plans, and recommendations are generated by AI based on the inputs you provide. We work to make them helpful and safe, but they may contain errors. Use common sense. If something doesn't fit your body, equipment, or condition, modify or skip it.
8. Intellectual property
The Service, including its content, software, and branding, is owned by us and our licensors. We grant you a personal, non-exclusive, non-transferable right to use the Service for your own use.
9. Your content
You retain ownership of data you submit (for example, your profile, logged workouts, logged meals). You grant us a limited license to host, process, and display that data as needed to operate the Service for you.
10. Termination
You may stop using the Service and delete your account at any time by emailing support@lyvitnow.com. We may suspend or terminate accounts that violate these Terms or threaten the integrity of the Service.
11. Disclaimer of warranties
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. Early access features may change, break, or be removed as we iterate.
12. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim related to the Service is limited to the greater of one hundred U.S. dollars or the amount you have paid us in the 12 months before the claim arose. During free early access, no fees have been paid.
13. Changes to the Service or Terms
We may change features, pricing, or these Terms over time. We will give reasonable notice of material changes by email or in the app. Continued use after changes take effect means you accept them.
14. Governing law
These Terms are governed by the laws of the jurisdiction in which AlyveVentures is organized, without regard to conflict-of-law rules.
